Injured judge happy to skip wheelchair lift

But Lipscombe, now using a wheelchair, isn't sitting at his bench, several feet above the rest of his courtroom, as he normally would. Because the courtroom doesn't have a wheelchair lift and because of other reasons, Lipscombe is presiding over his court from where his bailiff usually sits. Defendants look down at the judge when standing before him.
"See what happens when you miss a couple months of work? You get demoted, man!" lawyer Lawrence Schaubhut Sr. recently joked to the judge.
In May , county commissioners unanimously approved $50,000 from allocated reserves for improvements to accommodate Lipscombe and his wheelchair at the Blackwell-Thurman Criminal Justice Center .
But Commissioner Sarah Eckhardt later asked the judge not to spend the money. She said there's a less-expensive option — switching courtrooms with one of two judges, who are not disabled but use wheelchair-accessible courtrooms. "It was a mistake, but it was the best decision based on the information we had," Eckhardt said of the May vote.
"I don't think it was thought through," said Eckhardt, a distant cousin of Lipscombe by marriage and a former colleague in the Travis County attorney's office .
County Judge Sam Biscoe said the money was necessary and required by law. "I feel I did the right thing by approving the funds," he said.
Lipscombe's bailiff, Sonya Torrez, said the adjustments are justified. "I just think it could be done. It's only fair. He had an accident, and anyone could have an accident," she said.
Nearly half the money already has been spent for a wheelchair lift in the parking garage, where work is under way.
Lipscombe recently decided not to install a lift in his courtroom and to sit at ground level while he's in a wheelchair for an additional six to eight months.
"My bottom line is still that unless the (Americans With Disabilities Act) or law requires us to put a lift or a ramp in my courtroom, I don't want to cost the county any more money. And I'm just going to hold court on the ground floor," he said.
